What NSW law requires from a seller

In NSW, every ad to sell or give away a puppy must include the puppy's microchip number and the breeder's identification number (BIN).

Anyone responsible for a dog that becomes pregnant must hold a BIN with active dog breeder eligibility, even if the pregnancy was accidental or a one-off. After an unplanned pregnancy, the person in charge of the dog must apply within 14 days of becoming aware of it, or 7 days after the birth.

A breeder must use their BIN in every ad and cannot use a recognised breeder organisation membership number instead. These strengthened advertising rules cover puppies born after 1 December 2025, and a breeder with an older BIN had to activate dog breeder eligibility on it to keep breeding after that date.

Designated rehoming organisations that intentionally breed dogs need a BIN too. They can use a rehoming organisation number (RON) instead when a pregnant dog comes into their care, or when a seized or surrendered dog in their custody becomes pregnant by accident.

A breeder must microchip every puppy they have bred before selling or giving away the litter, or by the time the puppies are 12 weeks old.
