These Terms & Conditions (“Terms”) govern your access to and use of pups4sale.com.au (“the Website”), owned and operated by Puppy Dog Pty Ltd (“we”, “us”, “our”).
By accessing, browsing, registering an account, or posting a listing on pups4sale.com.au, you agree to be bound by these Terms.

If you do not agree, you must not use the Website.

1. Eligibility to Use the Website

By using pups4sale.com.au, you confirm that:

•         you are at least 18 years old
   
•         you have the legal right to sell or advertise animals in your state or territory
   
•         all information you submit is accurate and lawful
   

2. Your Account

You are responsible for:

•         maintaining the confidentiality of your login credentials
   
•         all activity that occurs on or through your account
   
•         ensuring all information in your account is accurate and up to date
   

We may suspend or terminate accounts at our discretion if fraudulent, abusive, misleading, or harmful activity occurs.

3. Seller Requirements

By creating a listing, you agree that:

1.       All pups advertised are your property to sell, or you are authorised to sell them.
    
2.       All descriptions are accurate, honest, and not misleading, including:
    
   •         breed and pedigree
      
   •         colour
      
   •         temperament
      
   •         microchip and vaccination status
      
   •         health conditions
      
3.       All photos and videos used are either:
    
   •         your own; or
      
   •         used with written permission; and
      
   •         accurately represent the animals for sale
      
4.       Puppies will only be supplied to the buyer at 8 weeks of age or older.
    
5.       Vaccination and microchip certificates will be supplied to the purchaser at the time of sale.
    
6.       Any known health issues must be disclosed in writing before any payment (full or partial) is accepted.
    

Failure to disclose health issues may entitle the buyer to a refund (see Section 9).

4. Breeder Registration Numbers

Where state or council regulations require a Breeder Identification Number (BIN) or equivalent:

•         you agree to supply your valid registration number upon request by the purchaser
   
•         you agree to comply with all local legislation regarding breeding and animal welfare
   

We do not require these numbers to be displayed publicly on the Website, but buyers must be provided with them at the point of sale if legally required.

5. Listing Approval

All listings submitted to pups4sale undergo manual admin review.

We may approve, reject, or remove listings at our sole discretion, including if they:

•         contain false, misleading, or unethical content
   
•         appear related to puppy farming or neglect
   
•         involve illegal breeds (eg. Pitbull, Dogo Argentino, Japanese Tosa)
   
•         contain defamatory or abusive statements
   
•         violate these Terms or any applicable law
   

We are not required to provide an explanation for rejections or removals.

6. Payments, Pricing, and Subscriptions

6.1 Listing Fees

Listing fees are payable at the time of creating a listing.
Fees are clearly displayed before payment.

6.2 Payment Processors

Payments are processed by Stripe or PayPal.
By using these processors, you agree to their terms.

We do not store full credit-card details.

6.3 Featured & Homepage Gallery Subscription

If you opt into the Featured subscription:

•         the subscription renews monthly until cancelled
   
•         billing occurs automatically
   
•         you may cancel at any time through your account
   

No refunds are issued for partial subscription periods.

6.4 Refunds

If your paid advertisement fails to appear, or is not visible for the paid duration due to a technical fault on our side, we will refund the full listing fee to the original payment method.

Refunds do not apply where:

•         you remove your own listing
   
•         your listing is removed for violating these Terms
   
•         your listing is rejected due to false, misleading, or incomplete information
   
•         your internet connection or device prevents you from accessing the Website
   

7. Prohibited Activities

Users must not:

•         post false or misleading information
   
•         impersonate another person or breeder
   
•         upload third-party intellectual property without permission
   
•         engage in fraud or attempt to scam users
   
•         harass, defame, or threaten others
   
•         sell or advertise prohibited breeds
   
•         use our platform to facilitate illegal activity
   
•         bypass or manipulate payment processes
   
•         create multiple accounts to avoid suspension
   

8. Animal Welfare & Reporting

We do not support puppy farming or unethical breeding practices.

If we receive reports of:

•         neglect
   
•         poor living conditions
   
•         improper breeding practices
   
•         animal cruelty
   

we may notify the relevant authorities.

We reserve the right to suspend accounts involved in welfare concerns.

9. Health Guarantees & Buyer Rights

9.1 Known Conditions

If any pup in a litter, or the parents, have a known health condition at the time of advertising or during the listing period:

•         this must be disclosed in writing prior to any payment
   
•         failure to disclose entitles the purchaser to:
   
  •         a full refund of the purchase price
     
  •         reimbursement of freight costs (both directions)
     

9.2 Hereditary Conditions Discovered After Sale

If a qualified veterinarian determines that a pup suffers from a hereditary condition not known at time of sale, the buyer is entitled to:

•         a minimum 50 percent refund, and
   
•         the option to return the pup to the seller
   

This clause is consistent with standard breeder ethics across Australia.

10. Platform Role & Liability

pups4sale is a classifieds platform.
We are not a party to transactions between buyers and sellers.

Accordingly:

•         we do not guarantee the accuracy of listings
   
•         we do not vet buyers or sellers
   
•         we do not guarantee the health, temperament, or quality of any animal
   
•         we do not handle payments between buyers and sellers
   
•         all sales are solely between the advertiser and the purchaser
   

Buyers must conduct their own due diligence.

11. Limitation of Liability

To the fullest extent permitted by law:

•         we exclude all liability for any loss, damage, injury, cost, or claim arising from your use of the Website
   
•         we are not liable for fraudulent behaviour by users
   
•         we are not liable for inaccurate, misleading, or false listings
   
•         we are not liable for downtime, errors, or interruptions
   
•         your use of the Website is entirely at your own risk
   

Nothing in these Terms limits rights guaranteed under Australian Consumer Law.

12. Intellectual Property

All content on pups4sale.com.au, including text, logos, images, layout, design, and software, is owned by Puppy Dog Pty Ltd or licensed to us.

You must not copy, reproduce, scrape, or reuse content without written permission.

13. Indemnity

You agree to fully indemnify Puppy Dog Pty Ltd, its directors, employees, and agents from any loss, claims, damages, costs, or liabilities arising from:

•         your listings
   
•         your conduct
   
•         your breach of these Terms
   
•         your sale of animals
   
•         any disputes with purchasers or third parties
   

14. Website Availability

We do not guarantee:

•         uninterrupted access
   
•         error-free functionality
   
•         compatibility with your device or browser
   

We may suspend the Website for maintenance at any time.

15. Privacy

Your use of this Website is also governed by our Privacy Policy.
By using the Website, you agree to our data-handling practices.

16. Governing Law

These Terms are governed by the laws of Australia, and you submit to the jurisdiction of the courts of Australia.

17. Changes to These Terms

We may update these Terms at any time.
The latest version will always be available on the Website.
Your continued use of the Website constitutes acceptance of any updated Terms.
